Limits
SURROUNDING CIRCUMSTANCES: This claim
arose out of an automobile collision that took place on
January 26, 1996 at the intersection of Johnson Ferry
Road and Columns Drive located in Cobb County, Georgia.
At that time Mr. James W. Brewer was driving his 1986
pick-up truck and had been traveling northbound on
Johnson Ferry Road approaching its intersection with
Columns Drive. At the same place and time, Ms. Juanita
Elaine Francis was driving a 1986 Buick traveling
southbound on Johnson Ferry Road. As Ms. Francis
approached the intersection she lost control of her
vehicle and started sliding, thereby doing a full 360
degree turn striking a vehicle that was being driven by
Ms. Kathy Fry forcing Ms. Fry's vehicle into Mr. Brewer's
vehicle.
Ms. Juanita Elaine Francis was issued a citation and
pled guilty to the offense of "Driving Too Fast For
Conditions". Mr. Brewer's vehicle was driven from
the collision scene by him and he never went to the
emergency room.
Mr. Brewer first sought treatment from a chiropractor,
Dr. Michael Malloy, on the day following the accident.
While receiving rehabilitative chiropractic therapy, Mr.
Brewer was referred on February 23, 1996 to David D.
Hubbell, M.D. Dr. Hubbell sent Mr. Brewer to Health
Images of Atlanta where an MRI of the cervical spine
revealed advanced degenerative disc disease with disc
herniations causing nerve impingement at C5-6 and C6-7.
Dr. Hubbell then referred Mr. Brewer for a physical
therapy treatment program at Atlanta Physical Medicine
located in Smyrna, Georgia.
Mr. Brewer never had any surgery but received a twenty
percent (20%) permanent impairment rating to the body as
a whole from Dr. Hubbell. Total medical expenses were
$10,040.89 and the lost wage claim was $6,424.00. The
case was negotiated and settled for the policy limits of
$100,000.00 with Grange Mutual Casualty Insurance Company
who insured Ms. Juanita Elaine Francis.
