male Plaintiffs vehicle was struck from the rear
during rush hour traffic on I-285 and pushed into the
vehicle in front of him. Defendant contested liability on
the basis of sudden emergency by claiming that the
Plaintiff struck the vehicle in front of him prior to her
striking the rear of the Plaintiffs vehicle. There
were no eyewitnesses other than the parties. Plaintiff
had a history of neck and back injury from a prior rear
end auto collision three years earlier in which he sought
treatment and made a liability claim.
Injury: Cervical, thoracic and lumbar
strain.
Medical Expenses: $6,591.98
Verdict: $54,878.46
