Liability Facts: 46 year old female Plaintiff was guest passenger of Defendant co-worker traveling northbound on I-75 after leaving charity function where both had consumed alcohol. Defendant swerved suddenly to avoid other traffic causing the vehicle to overturn onto the passenger side. Both occupants were wearing seat belts and were not ejected. Neither occupant was transported to emergency room. Three days later Plaintiff presented herself to Kennestone Hospital complaining of right chest pain. Defendant contended that Plaintiff was contributorily negligent and had assumed the risk of injury by voluntarily riding with a known intoxicated driver.

Injury: Fracture of the right 7th rib, hematoma of the right breast, and neck and right shoulder sprain.

Medical Expert: N/A

Medical expenses: $8,107.00

Settlement: Case settled prior to filing suit for $75,000.00
